Will my K-1 application be affected by COVID?

You may have heard that COVID-19 led to delayed K-1 visa processing in many countries. The good news is that U.S. embassies and consulates have now been authorized to prioritize K-1 visas again. It is also important to note that U.S. Citizenship and Immigration Services (USCIS) is still accepting and processing Form I-129F (Petition for Alien Fiancé(e)). Even if you’re concerned about possible delays during the second, embassy stage of the K-1 visa process, applicants are encouraged to apply now, in order to jump-start the process.

My partner and I haven’t met in person yet. Can we still apply?

One of the government requirements to apply for the K-1 Fiancé Visa is that the couple has met in person at least once in the last two years at the time of filing. Even if you haven’t met in person yet, there are still several steps you can take to get a headstart on the process:

Can I include my foreign-born children on the application?

Yes! Similar to the K-1 visa process, the K-2 visa allows children of a K-1 visa application to enter the United States and later apply for a green card through the “Adjustment of Status” process.

To be eligible for the K-2 visa, the applicant must be the child of a K-1 visa holder, under the age of 21, and unmarried. They may travel with their parent, the K-1 visa holder, or later, but they cannot travel to the U.S. before their parent.
